These Terms and Conditions ("Terms") govern access to and use of the SocialBrandAcademy website located at https://www.socialbrandacademy.com and any related services, products, content, communities, downloads, courses, and features offered through the Site.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility
You represent that you are at least the age of majority in your jurisdiction, or that you are using the Site with legally sufficient permission and supervision where required.
2. Permitted use
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
violate any applicable law or regulation;
infringe intellectual property or other rights;
attempt unauthorized access to accounts, systems, or networks;
interfere with Site security or performance;
upload malicious code, spam, or harmful content;
scrape, copy, reproduce, resell, or exploit Site content except as expressly allowed; or
use the Site in a way that could harm SocialBrandAcademy, its users, or third parties.
Canadian website terms commonly restrict use to lawful purposes and require users to comply with applicable laws when accessing and using a website.
3. Accounts
If the Site allows account creation, you are responsible for maintaining the confidentiality of login credentials and for all activities under your account. You agree to provide accurate information and to update it as needed.
SocialBrandAcademy may suspend or terminate accounts that are inaccurate, insecure, inactive, or used in violation of these Terms.
4. Purchases, programs, and subscriptions
If SocialBrandAcademy sells courses, memberships, coaching, templates, digital products, subscriptions, or other paid services, the following terms apply unless separate written terms state otherwise:
Prices are shown in CAD and may change at any time.
Payments are processed by third-party processors.
Taxes may be added where required.
Access to digital products or memberships may be granted only after successful payment.
Specific offers may have separate refund, renewal, trial, cancellation, or access terms displayed at checkout or on the sales page.
Refund Clause:
Except where required by law or expressly stated otherwise in writing, all sales of digital products, downloaded materials, courses, and membership fees are final and non-refundable.
Refund Policy (7-Day Cooling-Off Period)
You may request a refund for your purchase within seven (7) calendar days from the date of purchase (the “Cooling-Off Period”). Refund requests submitted within this period will be eligible for a full refund, provided that the product or service has not been substantially used, accessed, or consumed, unless otherwise required by applicable law. After the expiration of the Cooling-Off Period, all sales are final and no refunds, credits, or exchanges will be issued.
To request a refund, you must contact us within the Cooling-Off Period at support@socialbrandacademy.com with your order details.
We reserve the right to verify eligibility and to refuse refunds that do not comply with this policy.
Refunds, if approved, will be processed using the original method of payment within a reasonable timeframe.
5. Intellectual property
All content on the Site, including text, graphics, logos, videos, downloads, course materials, designs, trademarks, and software, is owned by or licensed to SocialBrandAcademy and is protected by intellectual property laws. Except for limited personal, non-commercial use expressly allowed by SocialBrandAcademy, no content may be copied, modified, distributed, republished, displayed, sold, licensed, or exploited without prior written permission.
6. User content
If you submit comments, testimonials, reviews, assignments, messages, posts, images, or other content to the Site or to SocialBrandAcademy, you represent that you have the right to do so and that the content does not violate any law or third-party right.
You grant SocialBrandAcademy a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and distribute that content for operating, promoting, and improving the Site and related services, unless otherwise agreed in writing.
7. Educational content disclaimer
Content provided through SocialBrandAcademy is for educational and informational purposes only. No content on the Site is legal, financial, tax, employment, mental health, or other regulated professional advice unless expressly stated otherwise in a signed written agreement.
8. No guarantees
SocialBrandAcademy does not guarantee any particular result, income level, audience growth, brand outcome, or business success from using the Site, courses, templates, or services. Results depend on many factors outside SocialBrandAcademy's control, including skill, experience, effort, market conditions, platform changes, and implementation.
9. Testimonials and examples
Any testimonials, reviews, case studies, or examples on the Site are illustrative only and do not guarantee that current or future users will achieve the same or similar results.
10. Third-party platforms
The Site may link to or integrate with third-party platforms, including social media services, payment processors, analytics tools, video hosts, or community software. SocialBrandAcademy is not responsible for third-party platforms, their availability, or their policies.
11. Disclaimer of warranties
To the fullest extent permitted by law, the Site and all content, products, and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, availability, or non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, SocialBrandAcademy and its directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings arising out of or related to the Site, even if advised of the possibility of such damages.
To the fullest extent permitted by law, the total liability of SocialBrandAcademy for any claim arising out of or relating to the Site, products, or services will not exceed the greater of: (a) the amount paid by you to SocialBrandAcademy in the 3 months preceding the event giving rise to the claim; or (b) CAD $100.
13. Indemnity
You agree to indemnify and hold harmless SocialBrandAcademy and its directors, officers, employees, contractors, affiliates, licensors, and service providers from and against claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or related to your use of the Site, your content, your breach of these Terms, or your violation of any law or third-party right.
14. Termination
SocialBrandAcademy may suspend, restrict, or terminate access to the Site or any account, content, or service at any time, with or without notice, where reasonably necessary to protect the Site, enforce these Terms, comply with law, or address misuse.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law rules. Any dispute shall be brought before the courts located in Ontario, unless applicable law requires otherwise.
16. Changes to these Terms
SocialBrandAcademy may update these Terms from time to time by posting the revised version on the Site with a new effective date. Continued use of the Site after the updated Terms become effective constitutes acceptance of the revised Terms.
